All trademarks, services marks, trade names, and trade dress are proprietary to the Company. No information, content or material from the website and / or services may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without the company's express written permission.

Your Obligations to Odeh Wellness:

Your Representations. You represent and warrant to us that: (a) you have the legal capacity to understand and enter into this Agreement; (b) you are of at least 18 years of age; or you have permission from your parent(s) or legal guardian(s) to use the Services; and (c) all information you give us is valid and true and yours to provide to us.

Your Account. In order to use certain features of the Services, you may be required to provide log in information in order to create an account (“Account”). As part of the registration process and as a condition of your access to the Services, you may create one Account only and provide us with your current, complete and accurate information (“Account Information”). If your Account Information changes, you must promptly update your Account to reflect those changes.

Each Account is for the personal use of the registered user only. You may not share your log-in details or password (if required) with any other person. Odeh Wellness does not allow multiple users (networked or otherwise) to access the Services through a single name and password. You may receive emails from us confirming the details of your registration and providing you with necessary information relating to your access and use of the Services and your Account.

We will not disclose your Confidential Information to third parties, except as required in the course of providing our Services. “Confidential Information” includes any materials or information provided by you to us which is not publicly known. Confidential Information does not include information that: (a) was in the public domain at the time we received it; (b) comes into the public domain after we received it through no fault of ours; (c) we received from someone other than you without breach of our or their confidentiality obligations; (d) we are required by law to disclose; or (e) that you have given your consent or instructed us to disclose.

If you remove content, delete your account or if these Terms of Service are terminated, we will be permitted to retain a copy, including archives, of your Confidential Information or any information that is related to your account (including Content and personal information) if such retention is necessary to meet our legal and compliance obligations.

Account Cancellation

If you wish to cancel and remove your Account, please send us an email to ([email protected]). Your Account will terminate within reasonable time following your request, and from that date of termination you will no longer be able to access your Account. Note that you will be able to edit or remove, at any time, any information contained in your Account.

Cancelling your account may cause the loss of certain information you provided us and Odeh Wellness does not accept any liability for such loss. Please note that we are legally obligated to keep health information even if your account has been terminated, and such information will be deleted only when and if allowed according to applicable laws.

We will use your Account Information and any other personal information provided by you to us in accordance with our Privacy Policy.

Please note that you are still liable for the full amount of the price of the course if the refund period has passed. This remains true whether you paid as 1 time payment or using a payment plan.

The information contained in the Website (including, the Discussion Forums) may contain technical inaccuracies or typographical errors. We reserve the right to make changes and improvements to any information contained within the Website, at any time and without notice.

Registering for an Account

The Website Discussion Forums are community sites to which you can submit details of your health experiences for display, indexing and feedback from other registered users.

If you choose to register for an account with our Website then if you select, or you are given, a user identification code, password or any other piece of information as part of our registration or security procedures, you must treat such information as confidential. You must not disclose it to any third party.

IN NO EVENT SHALL ODEH WELLNESS OR DR HASAN ODEH OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING INCLUDING NEGLIGENCE). YOU AGREE TO INDEMNIFY AND HOLD US AND (AS APPLICABLE) OUR PARENT, SUBSIDIARIES, AFFILIATES, ODEH WELLNESS PARTNERS, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS’ FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

Odeh Wellness and/or Dr. Hasan Odeh does not warrant that the quality of any products, Services, information, or other material purchased or obtained by you through the Services will meet your expectations, or that any errors in the Services will be corrected.

IN NO EVENT WILL Odeh Wellness and/or Dr. Hasan Odeh AGGREGATE LIABILITY FOR ALL CLAIMS OF ANY KIND, INCLUDING ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER BY STATUTE, CONTRACT, TORT, OR UNDER ANY OTHER THEORY OF LIABILITY, EXCEED THE FEES PAID FOR YOUR COURSE.

System Unavailability.

There may be times when the Services are unavailable due to technical errors or for maintenance and support activities. We do not represent, warrant, or guarantee that the Services will always be available or is completely free of human or technological errors.

Compatibility.

You must provide the equipment and Internet connections necessary to access the Services at your own expense. We do not guarantee that the Services will operate with your computer, Mobile Device, internet service plans, or Mobile Provider service plans or with any particular computer or other piece of hardware, software, equipment, or device you install on or used with your computer.

Data Security:

You understand that your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.

Account Disputes:

In the event of a dispute regarding account ownership, we reserve the right to request documentation to determine or confirm account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government issued photo ID, the last four digits of the credit card on file, etc.

Odeh Wellness  retains the right to determine, in our sole judgment, rightful account ownership and transfer an account to the rightful owner. If we are unable to reasonably determine the rightful Account Owner, Odeh Wellness reserves the right to temporarily disable an account until resolution has been determined between the disputing parties.

Waiver and Complete Agreement

The failure of Odeh Wellness to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Odeh Wellness and govern your use of the Services, superseding any prior agreements between you and Odeh Wellness (including, but not limited to, any prior versions of the Terms of Service).

Payment of Fees & Refunds

A valid credit card is required for accounts able to process orders using a live payment gateway. The course is sold in two options, either as a 1 time payment, or through a payment plan. Our service is not a subscription website. Meaning that if you cancel your account you will still be liable for the full amount unless you are within the satisfaction guarantee period of 14 days of purchase.

You can ask for refunds within 14 days of your purchase. Odeh Wellness retains the right not to issue a refund if we suspect at our full discretion that you are in breach of the terms and conditions.

We use third party companies (stripe, PayPal, Thinkific Payment) to process our payments. Refunds are also processed through them. Please refer to the terms of use for further details. We have no control over how fast they will process your refunds.

Procedure for Reporting Copyright Infringement

If you believe that Content residing on the website or Services infringes a copyright, please email a notice of copyright infringement containing the following information to [email protected]

A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;

Identification of works or materials being infringed;

Identification of the Content that is claimed to be infringing including information regarding the location of the Content that the copyright owner seeks to have removed, with sufficient detail so that Odeh Wellness is capable of finding and verifying its existence;

Contact information about the notifier including address, telephone number and, if available, e-mail address;

A statement that the notifier has a good faith belief that the Content is not authorized by the copyright owner, its agent, or the law; and

A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

Odeh Wellness will review the information and contact you withing 24 hours by email or phone if provided. If the dispute is prolonged we will remove the content until the dispute is resolved.

Languages

The parties have agreed that this arrangement will be established and all related documents be written in English.
